What should happen to malpractice coverage when a lawyer leaves?
Review the departing lawyer's prior work, insured status and reporting arrangements under both firms' policies. Address prior acts or tail options before departure; coverage does not follow a lawyer automatically in every situation.
Does tail coverage insure new legal work?
Tail coverage extends reporting time for certain claims relating to earlier covered work. It generally does not insure new services after the policy ends; review the endorsement's dates, duration and other terms.
Does a crime policy cover money held for clients?
Check explicitly. Review whose money is covered, theft by employees or partners, and social engineering provisions. Trust-account procedures and payment verification should match any conditions in the policy.
Do defense costs reduce the malpractice limit?
They can. Compare whether defense is inside or outside the limit, how the deductible applies, and whether related claims share one limit. These details can change the amount available for settlement.
